1. OBJECT

1.1.The purpose of these Terms and Conditions of purchase is the Barista Shop supply of the products offered through our online store, in exchange for a financial benefit.

2. ENTRY INTO FORCE

2.1. These Terms and Conditions together with your Order Confirmation constitute the contract between Barista Shop and the Client for the supply of products. Any other Terms and Conditions do not apply.
2.2. It is understood that the Client agrees with the general conditions in this text from the time you accept that you have read and agreed to these Terms and Conditions.

3. AVAILABILITY

3.1.It should be noted that orders will be shipped within the limits of stock availability. If one of the items ordered were not in stock, we send the Client an e-mail as soon as possible (from the date you placed the order) to tell the time in which product(s) can be sent. If you were not interested in waiting, a refund of any amount paid for the products can be made.

4. PRICES

4.1. The price of each product will be determined clearly on the website. The price and terms of the products offered will vary, but in any case, it will be applied to the Client the price and the conditions that existed when the order was placed.
4.2. The sale prices listed in our online shop are displayed including VAT.

5. PRODUCT SUPPLY

5.1.We will supply the products indicated in the Order Confirmation, pursuant to these Terms and Conditions.

6. PAYMENT OF PRODUCTS

6.1. If our security department suspects an anomaly or fraud, Barista Shop reserves the right to cancel the transaction for security reasons.

6.2 Method of payment: PayPal allows you to pay directly without communicating financial data online. PayPal automatically encrypts confidential data with the help of the best technologies available in the market.

6.3. Shipping to Peninsula will be paid for orders above 80 €. For smaller orders, the system will calculate the shipping.

6.4. If you are ordering from Ceuta, Melilla, Canary Islands, Balearic Islands or out of Spain, the system will calculate shipping.

7. PERSONAL DATA PROTECTION

7.1.Personal data which Customer has to provide are essential for sending orders and bill drafting. The absence of these data will result in the automatic cancellation of orders. By entering the site, the Customer agrees to provide valid personal information, data that enable service delivery by Barista Shop and the correct identification of the registered customer and sending information and advertising of different products and offers that Barista Shop may have on its websites.

8. PRODUCT WARRANTY

8.1.Our products offer the guarantee granted by the manufacturer, as established by Royal Decree 1/ 2007 of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users and other complementary laws.
The bill in your name sent with the order and by email (if required) attached as a PDF file as the product leaves our warehouse is the Warranty to be presented to our brand qualified service, so it is important to print and save it.

9. MAKE A REQUEST

9.1. The Client must complete the Personal Data Form found in our online store (available 24h/day, every day), once you have accessed the page and clicked on the “Checkout “.

9.2. If we accept the order, we will notify the Client our acceptance by issuing an Order Confirmation. We will deliver your order confirmation email, provided that you have given us your email address in the personal data form. If we cannot accept the order, we will attempt to contact the customer via email or phone.

9.3. Although we make every effort to supply the products listed in your Order Confirmation, there may be occasions when we are unable to supply such products because, for example, that such products are not in stock. In these cases we will contact the customer to inform and suggest alternative products that might wish to purchase. If you do not accept our suggestions we will cancel your order in respect of the products we cannot supply and refund you the correspondent sum of money. The refund will be the limit of our liability to Client in case we are unable to supply the products ordered.
Sometimes the price of a particular product from our online store may be wrong and show a higher or lower price due to an error. When this happens and if you have your order confirmed, we will contact the Client as quickly as possible.

9.4. The customer may cancel the order at any time and at no additional cost, provided that the order has not been billed and sent through the carrier. If the package had left our factory, a refund shall be made.

9.5. The availability of products on the web is constantly changing and reflects the situation in real time. Adding an item to the shopping cart does not guarantee that it is reserved for the customer, other customers may have purchased while they were browsing the web. By the time you have completed the payment process, the product is reserved for the customer.

10. DELIVERY OF PRODUCTS

10.1. Products will be shipped to Client to the delivery address stated on your personal data form.

10.2. Products will be delivered once Barista Shop has verified the effective realization of the payment was successful. We are distributing our packages by Express courier. Shipments to the peninsula usually take 1 to 3 business day, shipments to the Balearic Islands within 2-5 business days. For shipments outside the national territory, Ceuta, Melilla and the Canary Islands please contact info@baristashop.com to check delivery times. All shipments are subject to product availability.

11. THE RIGHT TO RETURN THE PRODUCT

11.1. Contact info@baristashop.com and we will show you how to proceed. If the return is for a defective item or wrong item, it must be notified within 5 days after receipt of the goods and we will remove it for free, otherwise, we will also pick up the product but transport costs are on your expense.

11.2. A return or exchange will not be accepted if the product has been opened or manipulated by the Customer. Otherwise the goods will be depreciated and notify the customer upon receipt of return.

11.3. The deadline for any refund is 5 days after purchase.

11.4. The product must not have been used and must be returned in its box / original packaging external and well protected to avoid damage in transit. Otherwise the goods will be depreciated and notify the customer upon receipt of return. In addition, the documentation must include all original as we received at home.

11.5. Once we receive the merchandise in our warehouse and checked all the conditions above, the return of the product will be accepted and we will proceed to refund the amount, according to the method of payment used by the customer.

11.6.The company has the right to reject any product that does not come in a suitable condition for resale. These products will be returned to sender without notice. Only in the case that the company sent a wrong product, the cost of return and replacement will be on the company.

12. COMMENTS

12.1.All opinions written by the Clients are checked. If the feedback received break the law, ethics or morals (abusive publicity, defamation, insults, out of context …) , Barista Shop reserves the right to reject or modify those views.

13. OBLIGATIONS OF BARISTA SHOP AND CLIENT

13.1. Barista Shop agrees to make available to the Client all necessary information on the products offered as well as orders. Barista Shop is not liable for non-fulfillment of these conditions in case of force majeure and in case of failure of the Customer or any unforeseeable by a person outside the contract.

13.2. The Client agrees to fill the order forms and fields according to the instructions. Barista Shop protects data according to law. Client also agrees to pay the price of the product, applicable taxes and shipping charges.

13.3. Barista Shop is not responsible for any consequences that may result from improper use of the products sold through their online store.
